    I listen to him frequently. I'd strongly recommend not contacting him. Even if he is pro legal immigration, he is very moody and could say something bad that we don't want to hear. He likes Indians but hates Chinese. He also hates Tabla by the way!

    Sean Hannity could be a better option.

    Can't we have the website admin clean up and get rid of old items (action items, news etc) cluttering the main page of IV and put this in bold? Some of the most important and interesting action items (FOIA request, this one etc) are buried in forum threads and need to be bumped up.

    I doubt that there is any "transfer tax". As long as you have filed your income tax return that showed the source of that "saving" (good job there), you have already paid taxes on it. Also, your parent don't have to pay any tax on it since there can be no double taxation of the said money.

    I think USCIS is working towards reducing the backlogs. It could be starting point for all EB community to feel better

    With IV success, I foresee the EB categories as current at any point of time. And GC process is less than 3 years for any EB category

    Hi
    I am in 7th year of H1b now..last time my h1b was renewed dates were until April 2008. I went to india in Dec 2006 and came back in Jan 2007. My passport was expiring on Sept 29th 2007 so Immigration officer dated my I-94 until sept 29th 2007 and told me same thing that you can go to any port of entery or international airport and meet USCIS officer and extend your I-94 with your new passport. I waited until last moment and around sept 24th I went to USCIS officer on airport as well as on Port of Entry (called Deffered Inspection site). Both places got answer you need to file extention online because we only correct mistakes and this is not a mistake but it was case of passport expiration. I called my lawyer, my hr, my company lawyer. Everyone told me I cant work after 29th sept as my i-94 is expiring. Thats same as your H1 expiring. SO either leave country and comeback with new stamping or file new h1b. I ended up filing new H1b as i had only couple of days left before my I-94 would have expired. I have filed I-485 and ead and my I-140 is pending. My pd is Dec 2003. As per my lawyer I want be out of status as mY I-485 is pending but I will loose eligibility to work as I wont have any work authorization once my I-94 expires and dont have EAD approved on my hand. I hope this helps you.

    Government dictates the rule for granting F1 non-immigrant visa and eligibility of a school or its programs to admit students under such provisions. When a student is at the school, the school/department has full control on what are the conditions for an international student to be on a valid visa. For example, some schools enforce 9 credit requirements per semester while other requires 12 (so yes school dictates these details) or some have no such requirements such as Kaplan/Language schools etc. There are other details too like duration of completion and criteria for expulsion. In violation of any of these conditions each school can cancel F1 status based on its own rules. Government doesn't dictate on what criteria can a school expel a student and thereby voiding his/her F1 visa status.

    As for intent, merely showing an intent is different from actually changing visa status. F1 with a pending AOS is a gray area for precisely the same reason. The best thing an F1 student could do is to complete the course meeting the F1 criteria of possible and/or switch to EAD by formally taking up an employment and filing I-9 which will be same as changing status explicitly.

    As for previous non-immigrant status it remains so until one uses EAD regardless of what that status was. There is no ambiguity in it, that's why people obtain EAD and never use it to maintain their previous non-immigrant status. If you maintain a valid F1 status and say your I-485 is denied you are still safe because your F1 status is still valid, it didn't go away just because you showed an intent to immigrate by filing I-485. That's what I was suggesting to original poster, if for some reason you prefer to maintain non-immigrant status you should keep either F1 or H4 whichever is convenient to you.


    The school policies does not determine whether someone can be on F1 status or not. Government has laid down the rules for F1 status. School cant say that one has to take so many credit hrs for that person to be on F1. The rule is that to maintain F1 status, one has to be a full time student with minimum 3 courses , thats 9 credit hrs, but the exception is the final semester where that student can have less then 9 credit hrs.

    Plus since the F1 is not a dual intent visa type , when someone applies for 485 , the F1 status is forfitted. what you are mentioning about the previous non-immigrant visa status continues even after obtaining EAD and remain so until EAD is used only applies to the non-immigrant status like H1 , H4 , L1 etc which are dual intent visa types. For F1 your statement does not apply.

    "Representative Elton Gallegly (R-CA) introduced H.R. 133, Citizenship Reform Act of 2007, which would limit citizenship by birth to children born to at least one permanent resident or citizen parent."


    Does this mean that if we do not have green cards our childern born here are not citizens. Am I understanding it right..
    This is just a proposal still and I fell will not become law anytime soon.

    Non-Immigrants - All talk and no action?

    I have been a silent member of ImmigrationVoice.org, a group formed by and for Highly Skilled Non-Immigrants wishing to legally migrate to the US to lobby Congress for reforms. When I first heard about ImmigrationVoice on another immigration bulletin board, I was curious to find out what their agenda was. With an ambitious goal of reforming the immigration system to favor the Highly Skilled Immigrants and with a little over 200 members, I was one amongst the next 100 who hoped that this then small organization would make a difference and signed up. I am here on a H1B work visa and still have 3 years left. I know that this struggle has to start for me now for it would be too late.

    By now, the organization had grown to almost 3000 members and with a dedicated team of advisors and group members, they made a bang in the immigrant community last year by going on a PR spree and even rallied amendments through prominent pro-immigrant senators and lobbying firms to include/introduce amendments in the failed 2006 CIR bill, all through meagre finances (compared to other anti-immigrant groups) albeit rich with passion and hope.

    I consciously started donating not because I was hoping that something WILL happen, but atleast with the hope that I tried to make it happen and that I can proudly go down if it didn't. People have almost always benefited from the actions of a small group of highly motivated individuals who tried and tried and tried. Some succeeded but some failed. Those who led and won will make history. Those who followed and won will proudly remember the history. Those who refused to follow and still won will with guilt remember the history.

    Hope is the quintessential trait of a successful person. If I knew how to predict the future, I wouldn't be here. What is important is that behind hope there is always strength. Mahatma Gandhi once said that "Strength does not come from physical capacity. It comes from an indomitable will".


    Every non-immigrant has the indomitable will to succeed based on his/her definition of success. I had the indomitable will to fly 12,000 miles to a destination I had never been to, clutching a scholarship and hope. I had the indomitable will to persist after 9/11 to find a job. If I didn't I would have called it quits and returned back home. My friend almost got killed at a gas station. Why? He had the indomitable will to try to stand up on his own to pay his tuition and living expenses. There are several stories of sacrifices and will power that constantly amaze me even till this day. One guy worked at a meat packing plant to earn minimum wage while simultaneously studying for a triple major. The worst part of his story was that he comes from a strict indian family of orthodox brahmins who by tradition and religion consider all living beings sacred.

    When you hear these stories of how people have lived their lives to reach wherever they are, lobbying for a reform should be an easier task. Its not rocket science. Just like americans, we non-immigrants take our rights for granted. "We pay taxes. We pay Social Security. We pay Medicare. We pay state taxes. etc. etc." SO WHAT? You drive a car, get excellent health care, make enough money to buy your parents a house/car, parade yourself everytime as the rich successful lad who left the shores to the land of opportunity everytime you visit your motherland. At what cost?

    Sometimes, Charles Darwin's quotes come to my mind; Like this one - "It is not the strongest of the species that survives, nor the most intelligent that survives. It is the one that is the most adaptable to change."
    We, non-immigrants adapt ourselves to the utmost degree that we almost always end up trying to find the easy route in order for us to preserve our way of life in the name of adaptiveness.

    John Porter counters Charles darwin by saying-"People underestimate their capacity for change. There is never a right time to do a difficult thing. A leader's job is to help people have vision of their potential."

    In my humble opinion, that is exactly what ImmigrationVoice.org has been trying to do.

    Off late, it seems that a majority of the members seem to bring in their own agenda and rally behind their own agenda completely devoid of ImmigrationVoice.org's objectives. There was not one bulletin board thread which has never sidetracked from the topic of discussion. In the name of constructive criticism or the character of the devil's advocate, a small minority have caused confusion and resentment of the objectives of ImmigrationVoice.org. For those members, I suggest that you read the objectives of ImmigrationVoice.org and subscribe to them or look for another group with common objectives such as yours.

    I have always had the opinion that if you can't get it done, step aside and let someone else do it. Observe, encourage, argue with a discipline and respect like a professional, but don't leave. Every single ounce of hope is required to achieve ImmigrationVoice.org's goals. Its hard to convey emotions through words, but I do know that deep within every non-immigrant's heart, there is a passion for success, hard work, commitment and willpower. If not, we wouldn't be forcing the nation/world to take notice of us or atleast try doing so.

    Ignore the Receipt Date on transfer notices. I have the same situation, receipt date on transfer notices was Sep 19, but the receipt date is Jul 23. I checked the receit notices, and they have the right receipt date. Only the receipt date on the receipt notices matters.
    We received all four I-485 Transfer Notices today which says they transferred our cases to LIN. My I-140 was approved from LIN, so this is ok.

    But the strange thing is both the Receipt Date and the Notice Date is September 26, 2007. Should I be worried?:confused:

    I also applied EAD and AP. Would that means CSC is sill holding back my EAD and AP applications for adjudication?
